These Terms of Service (“Terms”) govern your access to and use of the website located at ttenley.com and any related pages, content, products, and services we offer through it (together, the “Site”). The Site is operated by Tenley E. Raj, doing business as Tenley Films (“Tenley Films,” “we,” “us,” or “our”).

By accessing or using the Site, placing an order, subscribing to communications, or otherwise interacting with the Site, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree, please do not use the Site.

2. Who we are and how to reach us

7. Products, orders, and payment

The Site may offer merchandise and other products for sale (the “Shop”). The following terms apply to all purchases.

Product information. We try to describe and display our products accurately, but we do not warrant that product descriptions, colors, sizing, pricing, or other content are complete, current, or error-free. Product images are for illustration and actual items may vary. We may correct any error, inaccuracy, or omission at any time, including after an order has been submitted.

Pricing and availability. All prices are listed in U.S. dollars unless stated otherwise and do not include taxes or shipping unless stated. Prices and availability are subject to change without notice. Products are offered subject to availability, and we may limit quantities or discontinue any product at any time.

Orders and acceptance. Your submission of an order is an offer to buy. Risk of loss and title for physical products pass to you upon our delivery of the items to the carrier. You are responsible for providing an accurate shipping address; we are not responsible for items lost or delayed due to incorrect address information.

Returns, exchanges, and refunds. If we offer returns or exchanges, the applicable conditions and timeframes will be made available on the Site or at checkout. To the fullest extent permitted by law, our total aggregate liability for all claims relating to the Site or any product will not exceed the greater of the amount you paid to us for the product or service giving rise to the claim, or fifty U.S. dollars ($50). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless Tenley E. Raj and Tenley Films, and our affiliates, contractors, and service providers, from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or related to your use of the Site, your Submissions, your purchases, or your violation of these Terms or any law or third-party right.

Before filing any claim, you agree to first contact us at me@tttenley.com and attempt in good faith to resolve the dispute informally for at least thirty (30) days.

15. Miscellaneous

These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Site and supersede any prior agreements. If any provision is found unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them freely, including in connection with a sale or transfer of our business or assets.
